如果你最近要開發一個網站或者APP之類的軟件，那么，你肯定對“源碼”這個概念肯定不陌生，作為西安網站開發公司，我們非常不建議使用一些來歷不明的源碼開發網站以及任何系統。

 If you are planning to develop a website, app, or similar software recently, you must be familiar with the concept of "source code". As a Xi'an-based web development company, we strongly advise against using source code of unknown origin for developing websites or any systems. 

 源碼是一個網站APP系統的核心，但是開發一個APP或者網站的成本是比較高的，如果有類似功能的源碼，再進行二開或者直接搭建，成本就會低很多，所以有少部分軟件開發的個人或者公司，為了節約成本，就會使用一些來歷不明的源碼，進行網站開發。但是這些來歷不明的代碼往往是盜版的，存在著很多安全隱患以及版權糾紛。 

Source code serves as the core of any website or app system. However, the cost of developing an app or website from scratch is relatively high. Some individuals or companies engaged in software development may opt for using source code of unknown origin for secondary development or direct deployment when similar functional source code is available, as this significantly reduces costs. Yet these codes from unverified sources are often pirated, carrying substantial security risks and potential copyright disputes. 

這些源碼的來源，主要是從以下三個方面泄露出來的：

 The leakage of such source code primarily stems from three channels: 

 1.程序員交流論壇或者網站中 

比如在gethuib以及其他程序員交流論壇或者網站中，會自發的分享各種源碼，各行各業的都有，比如分銷商城、網站、家政、ERP之類的，有心之人就會下載用這些源碼，在給客戶交付時，使用這些源碼，進行軟件的二次開發，但是這類型的源碼，大部分會標注僅供學習使用，不得進行商用，你一旦商用，就有可能會被起訴。 

 Programmer discussion forums or websites Platforms like GitHub and other programming communities often see spontaneous sharing of various source codes across industries, ranging from distribution malls and websites to housekeeping services and ERP systems. Malicious actors may download such codes and use them in client projects for secondary development. However, most of these codes are explicitly labeled "for educational purposes only" with commercial use prohibited. Unauthorized commercial use could result in legal action. 

2.軟件開發公司的員工泄露出來的 

源碼也有可能是軟件開發公司，或者部分傳統行業的公司進行自研開發軟件時，對代碼管理的不夠嚴格，導致員工能接觸到項目的全前后的代碼，然后偷偷泄露出來，進行倒賣獲利。 

2. Leakage by software company employees Source code might also be leaked by employees of software development firms or traditional industry companies engaged in proprietary software development. Inadequate code management could allow employees to access full project codebases, which they then secretly leak for illicit profit through resale. 

 3.軟件公司，故意發布源碼然后釣魚執法 

一些軟件公司，故意把源碼發布到論壇里，釣魚執法，然后批量起訴，靠維權獲利。，你一旦商用，后門就會啟動，緊跟著傳票也就到了。如長沙某拓公司知識產權釣魚執法，故意在網站中使用免費下載等字樣，等你真的使用了，再進行起訴。 

3. Software companies intentionally releasing source code for "fishing enforcement" Certain companies deliberately plant source code on forums as bait, then initiate mass lawsuits for profit through intellectual property enforcement. Once the code is commercially used, pre-installed backdoors activate, followed by legal summons. A notable case involved a Changsha company (pseudonym "Tuotuo") using deceptive "free download" labels on their website to lure users into infringement before filing lawsuits. 

 根據安徽省知識產權事業發展中心網站中“靠“釣魚式維權”牟利？不可??！”的這篇文章中的數據顯示，該長沙某拓公司在全國21個省、市的31個中級人民法院都提起過訴訟，有的法院還在同一時間接到該案原告發起的十幾起案件的立案申請。截至2023年7月，該案原告已提起8149起著作權侵權訴訟，還有大量案件等待進入訴訟程序，總體數量非常龐大。 

Data from the Anhui Intellectual Property Development Center's article "Profit-Seeking Through 'Fishing Enforcement'? Unacceptable!" reveals that this Changsha company (code-named "Tuotuo") filed lawsuits in 31 intermediate people's courts across 21 provinces and municipalities. Some courts received over a dozen concurrent filing requests from the same plaintiff. By July 2023, the plaintiff had initiated 8,149 copyright infringement lawsuits, with numerous additional cases pending litigation, demonstrating the massive scale of this operation. 

 作為甲方，如何規避使用盜版源碼的情況 

最簡單也是最直接的，就是在和軟件開發公司簽合同時，一定要在合同中說明，軟件開發公司要保證源碼沒有版權糾紛，如果因為版權糾紛導致的損失應該由軟件開發公司承擔賠償責任。 

How can clients (Party A) avoid using pirated source code? The simplest and most direct method is to include explicit contractual clauses when signing agreements with software development firms. These clauses should require the developer to guarantee the absence of copyright disputes in the source code, with liability for any losses arising from copyright issues clearly assigned to the development company. 

 雖然會有不良西安網站開發公司使用這些源碼進行項目開發，但是大部分軟件公司的源碼都是沒有問題的，這篇文章僅僅只是提醒大家注意這些情況，并非所有軟件公司都會這樣。 

While some unscrupulous Xi'an web development companies might use such code for projects, the majority of software firms operate with legitimate source code. This article serves purely as a cautionary reminder about potential risks, not an indictment of all software development companies.
